BOOKING TERMS AND CONDITIONS

Section 1. Introduction

All customer must read the following terms and conditions carefully. No bookings can be made unless you understand and agree with the following terms and conditions. References to “us”, “we” and/or “our” in these Booking Terms and Conditions shall mean Bubble Bar. By booking our service you are deemed to have agreed to these Booking Terms and Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. Your booking confirmation invoice will highlight all the services to be provided. The booking confirmation invoice will be sent to your nominated email address.

Section 2. Covid-19

If government restrictions prevent your booking from going ahead on the date that you booked, your booking deposit may be transferred to a new booking. Any additional payments made can be used as a credit or will be refunded. Your booking will be deemed as a cancellation due to change of mind if it is possible for it to proceed but you wish to change or cancel your booking.

Section 3. Taxes and Surcharges

All advertised prices are inclusive of GST. Public Holidays and New Years Eve will accrue surcharges. Bookings made for the day preceding Pubic Holidays may be subject to a surcharge if our staff are required to work on the Public Holiday in providing our services for your event.

Section 4. Food Allergies

Our menu contains different ingredients which may contain allergens. Please let us know when booking in regards to your dietary requirements. While we take the utmost care to accommodate your dietary requirement, we cannot guarantee that there are no traces of allergens found in our food. We recommend that people with a life-threatening anaphylaxis inducing allergy cater their own food or drinks. We will not be held liable for instances where you and your guests suffer loss or illnesses resulting from traces of allergens found in our food or drinks.

Section 5. Booking on Behalf of Others

Only one person may be the designated contact per booking. We will under no circumstances be liable for any errors or omissions in the information provided to complete a booking. The designated contact person is responsible for making all payments due in connection with the booking, notifying us if any changes or cancellations are required and keeping your party informed.

Section 6. Accepting of Booking

If we accept your booking, we will issue a booking confirmation email that will include an invoice to your nominated email address. A contract will exist between us from the date we issue the invoice for the Booking Deposit.

Section 7. Booking Deposits & Payments

Subject to your rights under the Australian Consumer Law, all deposits are non-refundable for changes of mind or cancellations by you. You must pay 50% of your booking deposit within 48 hours of the acceptance of your booking or it will be cancelled. By paying the non-refundable deposit, you acknowledge and understand that the deposit represents the reasonable opportunity and administrative costs of making your booking.

The final payment of the remaining balance is required no later than 1 week prior to your event unless otherwise stated. Full payment must be made for services booked within 1 week of the event at the time of booking. We reserve the right to cancel your booking if final payment is not received.

Section 8. Bubble Bar Cart & Catering Equipment

Customers will be fully liable for all missing or damages done to our cart or catering equipment used for service. For any missing or damages done to our cart or equipment during the services to you, you agree to fully compensate us for any repair or replacement cost. Repair or replacement cost will be dependent upon the damage done which will include the total cost of us getting it repaired or replaced. The replacement value for each item is as per below. For any other item not listed in the table or the repair cost, an invoice will be sent to customer once item is replaced or repaired. Bubble Bar will have full discretion to decide whether it can be repaired or must be replaced.

Section 9. Access & Setup

You must describe the access point and distance to the desired setup position onsite. It is very important that you let us know of any steps, narrow doorways, tight turns or obstacles to ensure adequate time is allocated for setup. We must be provided with appropriate access time for setup and pack down if this is necessary to access the space. Please note that any delay in setting up or pack up time will incur additional fee or time deducted from your service time. Please note that if you wish to have an additional service or have the bar moved during service, you will need to contact us prior to arrange this. Additional charges will be incurred if the bubble bar is to be relocated during service or if an additional service is requested on the day.

Section 10. Shelter

You must provide our staff with shelter from the weather as per OH&S requirements. We reserve the right to refuse service if adequate shelter is not provided from the sun, rain and inclement weather.

Section 11. Cancellation By You

Subject to your rights under the Australian Consumer Law, all deposits are non-refundable for changes of mind or cancellations by you. A booking is deemed cancelled at the time written confirmation of the cancellation is received to our email bubblebarcatering@gmail.com. The following cancellation fees apply to all bookings.

  • Changes to, or cancellation of services within 1 week of the service date will incur a 50% fee.

  • Changes to, or cancellation of services within 24 hours of the service starting time will incur a 100% fee.

  • Changes to, or cancellation of services that has special order or personalise request will incur a 100% fee.

  • Failure to identify and inform us of any obstructions that prevent our equipment from being safely transported into the event space will deem your booking cancelled and a 100% fee will be incurred.

Section 12. Cancellation By Us

If we cancel your service, you can transfer amounts paid to an alternate date or receive a full refund.

Section 13. Unforeseen Circumstances

Except where otherwise expressly stated in these booking conditions, we will not accept liability or pay any compensation where the performance or prompt performance of our contractual obligations are prevented or affected by, or you otherwise suffer any damage or loss as a result of unforeseen circumstances. In these booking conditions, ‘unforeseen circumstances’ means any event which we, as the supplier of the service, could not, even with all due care, foresee or avoid. Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemics, fire, unprecedented traffic events and incidences and all similar events outside of our control.

Section 14. Credit Card Payments

All credit card payments will incur a surcharge of 2%. This is the surcharge we incur when taking these payments.

Section 15. Availability of Drink Options in Catering

Due to the mobile nature of our service and the variation in the preferences and drinking behaviours of different groups, we are unable to guarantee and accept no liability for each beverage’s availability throughout the service period.

Section 16. Menus

Please note that while we endeavour to offer the menus displayed at the time of booking, our menu selections, availability and pricing are subject to change without notice. For all verification regarding our menus please contact us prior to booking.

Section 17. Liability

We will not accept any liability or pay any compensation if you, any persons, your property or a property of third party suffer any damage, injury or loss arising out of our equipment during the time that you hire the equipment for your event.

We will not accept liability or pay any compensation if you, any persons, your property or the property of a third party suffer any damage, injury or loss when transporting our equipment at your direction.

Section 18. Photos and Marketing

You consent to us using all images taken during our service to you for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, irrevocable licence to use such images for publicity and promotional purposes.

Section 19. Pickup

All order must have a booking confirmation email prior to pickup. Customer will receive a booking confirmation email with the invoice, time, date, and location for pickup after their booking. A response must be received from customer to confirm their acceptance of the arranged pickup time. We will not be held liable for orders not made due to no response was received from customer. It is the responsibility of customer to make sure that they receive a booking confirmation email.

Please note our kitchen does not always have an attendee therefore we adhere strictly to all time scheduled pickup. We prepare all food and drink fresh prior to pickup therefore we cannot guarantee the quality of our products should it be pickup outside of the scheduled pickup time. Customer will be fully responsible for the quality of the food or drinks which is not pickup by the initial pickup time.

We will try to contact you 3 times and send a text message if needed. A 15 minutes period will be allowed for pickup. It is your responsibility to call us and reschedule another pickup time if you fail to comply with our scheduled pickup time. You may be charged additional fee for administration cost due to rescheduling. We cannot guarantee that another pickup time will be available.

All food or drinks not pickup by scheduled time or before 6pm of the same day will be disposed of. No refunds will be given for food or drinks that has gone bad or is disposed of due to delay or failure to pick up at scheduled time.

Section 20. Delivery

The following table relates to all orders for Party Size Cup.

For delivery fees relating to Self-Service and Bartending Service please refer to our packages available under those services.

Please make sure that all details given to us for delivery are correct. In cases where incorrect details are given, we will not be held liable for any damages or loss caused. All order must have a booking confirmation email prior to delivery. Customer will receive a booking confirmation email with the invoice, time, date, and location for delivery after their booking. A response must be received from customer to confirm their acceptance of the arranged delivery time. We will not be held liable for orders not made due to no response was received from customer. It is the responsibility of customer to make sure that they receive a booking confirmation email.

It is your responsibility to arrange for someone to be at the designated delivery address at the time of delivery. We will try to contact you upon arrival 3 times and send a text message if needed. If no response is received within 5 minutes, your order will be returned to our kitchen. It is your responsibility to call us and reschedule a delivery or pickup from our kitchen. You may be charged additional fee for administration cost due to rescheduling. We cannot guarantee that another pickup or delivery time will be available. Customer is fully responsible for the quality of food and drink not delivered by scheduled time.

If you have requested that we place your order in a designated location at the delivery address, this will be done so at your own risk. Compensation will not be given for food that goes bad or missing.

All food or drinks not delivered or pickup by scheduled time or before 6pm of the same day will be disposed of. No refunds will be given for food or drinks that has gone bad or is disposed of due to delay or failure to pick up or delivered at scheduled time.

Section 21. Additional Cost / Extra Time on Cart Hiring

Customer must provide Bubble Bar with reasonable time and access to pack up and collect all cart and equipment provided as stated on the invoice or the equipment rental agreement. Customer is responsible for organising another pickup if the initial pickup failed. We cannot guarantee the availability of pickup time and customer will be fully charged for all item hired per 24 hours interval for failed pickup.

Customer will be fully liable for all costs relating to the retrieval of all cart and equipment until it has been collected and returned to us. The costs will include, but not limited to, the package cost, travelling cost, third party hire, or any other costs relating to the retrieval of all cart and equipment. The costs will be calculated on a daily basis.

Section 22. Applicable Law

The Federal law & laws of NSW, Australia govern these Booking Terms and Conditions to the fullest extent allowable.
